1. Introduction

1.1 These Terms and Conditions apply to any bookings a student makes with ProFi Fitness School Limited from here after known as “PFS”. By booking a course, the student agrees that these Terms and Conditions shall apply in full to the delivery of the course by “PFS” and that they form part of the contract between the student and “PFS”.

1.2 No variation of these Terms and Conditions shall apply unless confirmed in writing by or on behalf of the Director of “PFS”. These Terms & Conditions are subject to change at the discretion of “PFS” without notice.

1.3 “PFS” shall not be liable for any loss, damages, costs, claims, demands, expenses or liabilities of whatsoever nature arising out of the delivery of the course to a student as a result of their act or omission including but not limited to the following:

  • The student’s failure to follow any oral or written instructions or recommendations in relation to the course/class.

  • The student supplies to "PFS" any information that is inaccurate, false, misleading or out of date.

  • Any loss or damage to any personal items and valuables which the student brings to a course.

2. Information About Us

2.1 The website (www.profi-fitness.ie) is operated by us. We are registered in Ireland under company number 9833929N. 

A list of approved education providers can be accessed on www.repsireland.ie (the national Register of Exercise Professionals).

2.2 All of our Fitness Certification Courses are recognised by the Register of Exercise Professionals Ireland with the exception of PFS FITNESS NUTRITION ADVISER,  and our short courses (CPD)/live online courses which are recognised by ACE (American Council on Exercise).  

2.3 All of our Teachers are fully qualified Tutors, Instructors and Evaluators and their biographies and qualifications are listed on our website at www.profi-fitness.ie

3. Eligibility Requirements

3.1 Participants are eligible for the "PFS" Courses if they are at least 16 years of age. If participants are under 18 years of age, all Course correspondence and payment transactions will be carried out with a parent or guardian.

3.2 "PFS" approves the principles of equal opportunity. Eligibility criteria for all "PFS" Courses are applied equally to all participants regardless of age, race, national origin, sexual preferences or orientation, or disability.

3.3 "PFS" provides a comprehensive support service for students with a disability. Students with recognised disadvantages or disabilities may be given special consideration.

3.4 Applicants need to notify us during the registration process if they suffer from any condition, injury or disability that is not self-diagnosed.

3.5 "PFS" approves course participants with pre-existing injuries, on the condition that a physician's note is provided and the person participating has a clear knowledge of their ability to perform the practical components of the course. The participant enrols on the course at their own risk and worsening of such injury will not be the responsibility of "PFS".

3.6 The default language for all "PFS" Courses and Examinations is English. We are unable to make any adjustments for students that have no English or have a poor understanding of English as our school neither provides language classes nor translation services.

3.7 The eligibility requirements for Courses vary. It is the applicant’s responsibility before applying, to ensure that all eligibility requirements for the Course have been met. If not certified with “PFS”, proof in the form of scanned certificates will need to be sent in reply to the registration confirmation email.

4. Registration Process

4.1 All participants are required to register for the "PFS" courses only via our website. We are unable to take registrations by means of telephone or email.

4.2 Applicants are responsible for any mistakes they make whilst filling in their personal information during the registration process. If the information that was filled or any part thereof is erroneous or incomplete, it will be printed as such on the Diploma. Any amendments that need to be made once the registration process is complete will incur a fee as per the Additional Costs List. If a Diploma has been printed with mistakes, the Certificate replacement fee applies.

4.3 The Student is responsible for notifying “PFS” of any changes to their address, phone number, etc. The notification has to be formally made via email with a scanned proof of change, e.g. any type of bill or document that contains the new address. The student has to specifically request that the Diploma has to be sent to the new address. In the absence of such a notification, "PFS" will send the Diploma to the address provided at registration.

4.4 After submitting an application, you will receive an e-mail from us acknowledging that we have received your application, along with all the information required for your course.

4.5 The course dates can be found on the “PFS” website. Once registered on a course, the Applicant agrees to participate in all the dates from that course. It is the duty of the Applicant to make the necessary arrangements both personal and with their employer. The student will support the costs of any changes or transfers in case their employer doesn't respect the arrangement. We are unable to accommodate any holidays once the course has started.

 

4.6.By signing up for the course, you agree to the dissemination by ProFi Fitness School of your image displayed in photographs and video materials, performed as part of the widespread use of business, by posting them on websites and disseminating in all media. Consent to the dissemination of the image is not limited in time and is also valid after the termination or expiration of the contract for any reason.

 

5. Bookings and Payment

5.1 All students will be required to sign to say they have read and understood these Terms and Conditions and if applicable the additional terms and conditions relating to payment by instalments given on the first day of their course.

5.2 Places on all courses are limited to 10 applicants unless advertised otherwise. The applicant is encouraged to pay a deposit as soon as possible in order to avoid disappointment.

5.3 Unless a full payment is made, paying a deposit is a legally binding commitment to pay the balance within the communicated time frame. A payment is required at the time of booking. Deposits are non-refundable. Payment times shall be of the essence. Failure to pay by the due date will result in the booking being cancelled and all payments made to date will be forfeited without liability on behalf of “PFS”.

5.4 All course bookings will be confirmed by “PFS” in writing to the email provided at registration.

5.5 All payments due to “PFS” shall be made without any deduction whether by way of set-off, counterclaim, discount, abatement, bank charges or otherwise.

5.6 No payments will be deemed to be made until “PFS” receives full payment in cleared funds.

5.7 "PFS" will send receipts to the email address provided during the registration process in electronic format only, upon receiving full payment.

5.8 Any amounts of money paid that are not used for a course within one year of the date of payment will be forfeited.

5.9 Students must raise any billing/receipt queries via email with “PFS” within 2 months of their course start date. Any queries relating to invoices, receipts, etc. from bookings older than 2 months will result in an administration charge as “PFS” maintains a data archival process to optimise the database performance.

5.10. Payment for the course must be received at least 5 days prior to the start of the course . If the payment is not received, PFS reserves the right to refuse course attendance.

5.11  CPD package promotions are only available for 1 day courses and do not include long courses.

5.12. CPD package promotions  are for 1 person only and cannot be transferred onto another person.

6. Course Places and Fees

6.1 All Course places are subject to availability and are available on a first come, first served basis.

6.2 Before paying any deposit or Course fees, applicants must ensure that they have read all the information available regarding Courses. Please contact "PFS" if you have any additional questions before you book and pay the deposit. The preferred communication method is email due to the fact that most “PFS” staff are actively teaching.

6.3 The Course Fees listed on the website are subject to change. Participants are required to pay the Course Fees listed for their Course on the website at the time of their registration.

6.4 "PFS" will guarantee a place on a Course if a Deposit has been paid to "PFS" within 5 calendar days. "PFS" cannot guarantee a place on a Course if payment of the Deposit hasn't been made within this period.

6.5 If a Course has been booked as a "special offer" including “Early Bird”, the Course Fees must be paid in full on the day of the booking or the place will be lost.

6.6 For "PFS" Diploma Courses there is an instalment plan available. A discount is available for upfront payment of the full balance. Missing one instalment payment will result in immediate termination of the student's participation in the course.

6.7 Multiple discounts can’t be accumulated on one course. No additional discount can be applied to a “PFS” course that is already advertised as a "special offer" including “Early Bird”. Vouchers and special discount codes can only be used against the regular price of a course.

6.8 "PFS" reserves the right to charge interest for course payments that are late. If you have not paid your Course Fee as agreed, we reserve the right to refuse permission to continue with your participation on the Course.

6.9 Participants will receive an instalment plan upon application for a course, however, the first instalment has to be paid upon registration.

6.10." PFS" reserves the right to cancel the course and offer alternative date should there was no minimum number of students ( i.e.4) signed up for the course.

6.11. Please be informed that penalty of 10 Euro will apply for each day the payment is overdue.If the payment is not received within 10 working days of the due date ,you will be excluded from the course .

 

6.12.Participants are required to pay in full before or on the first day of the Course if they did not apply for an installment plan. If such payment is not received, it will automatically mean agreement to move to installment option.

6.13. Installment amount is calculated €100 more expensive than the regular price. To avail of the lower price, the amount must be paid  before the start of the course.

6.14. "PFS" accept payments by Cheque, PayPal, Visa, Visa Debit, MasterCard, MasterCard Debit and Bank Transfer. We only accept payment over the phone in the event that a payment doesn’t go through, even though several attempts have been made and the information introduced was correct.

6.15. "PFS" examinations cannot be undertaken until all Course Fees have been paid.

6.16. Details of all charges are set out in the Additional Costs List attached to these Terms and Conditions.

6.17. All installments must be paid on time and according to payment plan sent by PFS. Failure to do so will result in a late payment penalty ( 10 euro for each day overdue).

8. Course types and Certificates

8.1 "Diploma Course" is a course with more than 5 days of teaching hours. All other courses are regarded as "Certificate Courses".

8.2 All Certificate courses are assigned Continuing Professional Development (CPD) points, at a rate of one point earned per hour completed.

8.3 Diplomas and Certificates will be issued with the name supplied on the application form and/or confirmed in the confirmation email.

8.4 Certificates will not be issued unless all fees have been paid in full and all requested documents have been received.

8.5 Replacement certificates can be obtained at the charge applicable at the date of ordering.

8.6 All certificates will be issued within 4 weeks after completion of the course.

9. Course Location

9.1 ProFi Fitness School is fully entitled to change the location of the course, prior to or after the planned commencement date due to foreseen and unforeseen circumstances that may occur, and prior to or during a course for the benefit of our clients and the company.

9.2 All our locations are rented. If we have to change the Location due to circumstances that are out of our control, we will notify the students promptly and we will strive for the change to be made to another location in the same city.

9.3 If the course location is changed, "PFS" is not responsible for any additional travel arrangements participants may have to make.

9.4 If during a course, a participant damages any equipment or any part of the building, the participant will be liable and will deal directly with the location's proprietors. "PFS" will not be held liable for such damage.

10. Course Cancellations

10.1 The student has the right to cancel the course booking.  Deposits are non-refundable so a partial retainment from the amount paid will be held if the student informs "PFS" at least 28 prior to the start date of the course.  No refund is offered if the applicant cancels the course 27-0 days before the course starts. Students are also required to notify PFS at least 10 days before the start of the course should they not attend the course.

10.2 If the applicant/student has cancelled he/she should return all course materials at his/her own expense, together with a formal email stating that he/she do not wish to proceed with the course. Should the course materials be damaged in any way, their cost will be deducted from any fees refunded. If the course has started, the student agrees that this right of cancellation shall not apply.

10.3 In the unlikely event that “PFS” has to cancel a course without being able to offer alternative dates, “PFS” will provide a refund up to the value of the course. Transportation and accommodation costs will not be covered.

10.4 If a student has started a course that is longer than one day, and one of the days of the course has to be rescheduled for reasons out of the control of "PFS", alternative dates will be offered as soon as they are available. No refunds will be offered if the student has attended any days of the course unless "PFS" cannot offer any alternative dates.

10.5 If a student does not start a course, this will be treated as a cancellation. Refunds will not be given if a participant cannot attend a Course. The only possible solution is transferring the applicant’s place to another date if the student can provide a medical certificate as a reason.

10.6 If a student stops attending without notifying “PFS” in advance, this will be treated as a cancellation.

10.7 In certain cases where a student misses required elements of a course for any reason, “PFS” reserves the right to cancel the student from the course. Alternatively, “PFS” may require the student to observe sessions on a later course before proceeding to assessment with costs covered by the student. Specific course requirements are outlined on the “PFS” website, in marketing material and in booking confirmation information.

10.8 It the students enrolls on the course which they can't attend and wishes to swap to another course and reschedule the current one, it is only possible if medical certs is provided.

10.9 Courses purchased at promotional prices are non - refundable.

10.10 Deposits are non -refundable.

10.11 Students attending long courses who can't attend a particular course day are required to notify PFS 10 days before the start of that module. Failure to do so will result in losing that day with no alternative offered. Should a student wish to attend that day in the future, this will be a subject to 50% of a regular price to be paid.

11. Refunds and Transfers

11.1 Course start dates may be subject to change. If a Course start date changes students will be offered the opportunity to transfer their application to the new date or to receive a credit note of the amount paid.

11.2 The student must notify “PFS” in writing via e-mail to office@profi-fitness.ie if they wish to transfer their original booking to an alternative date. If a change is requested 28 calendar days or more before the start of a course, no transfer fee will apply however the student will be liable to pay the difference in price for the course if applicable. “PFS” will charge a transfer fee in accordance with its current charges if the request is made within 27-14 days. This must be paid at the time of the transfer request. If a change of date is requested 13-0 days before the start date of a course, “PFS” may be unable to transfer the booking and all fees paid to date will be forfeited and the student will be liable to pay the course fee on re-booking of that course.

11.3 Any approved transfers must be within 6 months of the initial course date. After this period, all fees will be forfeited.

11.4 A transfer from one type of course to another can be made once only.

11.5 Transfer applications made during the Course will not be accepted.

11.6 If a transfer request is made for a Course that has been booked as a "special offer" including “Early Bird”, and if the transfer is approved, the Student needs to pay the difference up to the regular price and do so on the same day of the transfer being approved in addition to the transfer fee. The reason being is that the special offer is formulated for one specific date and location.

11.7 “PFS” is not obliged to refund any fees or offer an alternative date if a student fails to attend an exam.

11.8 If a student fails or cancels an assessment or exam they will be charged the current rate for re-booking. It is the student’s responsibility to re-book their assessment or exam and the booking will not be taken until full payment has been received.

11.9 If the conditions of a practical assessment are not complied with by the student they may not be assessed. Assessment instructions are given for each course and on the “PFS” website.

11.10 Transfers from assessments are treated in the same way as courses.

12. Attendance

12.1 In Certificate Courses: 100% attendance is compulsory due to the fact that CPD points are awarded per hour. Being late more than 15 minutes will be considered a missed day, and will result in automatic termination of your place on the Course, with no refund, in which case the Student needs to book a repeat and pay the valid price at the time.

12.2 In Diploma Courses: Lateness on more than 3 occasions will result in automatic termination of your place on the Course. In the case of missing a day, a Participant will only be eligible for a Diploma if the Participant attends the specific day at another Course or location.

12.3 Leaving early counts as forfeiture, regardless of the motive.

12.4 On all Courses, instructors reserve the right to terminate the participant’s place on the Course if continued participation is deemed a health or safety risk. Participants deemed unfit to continue the Course due to evidence of intoxication will be asked to leave the premises. If there is any type of retaliation against the “PFS” teacher, the matter will be taken up to the full extent of criminal and civil law.

13. Course Materials

13.1 The Lecturers’ PowerPoint Presentations are the intellectual property of “PFS” and will not be shared with the students outside of class or sent to the students in digital form.

13.2 One copy of the course materials are covered by the Course Fee. The materials are only in printed form and shall be given on the first day of the course. All our materials are protected by copyright laws and treaties. The student agrees not to replicate, alter, modify or distribute the materials or do anything which would infringe upon any rights.

13.3 Teaching materials for Diploma Courses will be printed and given to participants by the Tutor on the first day of the course.

13.4 If a course has been booked with less than 7 calendar days before the start date, PFS cannot guarantee that the student receives the Learning Materials on the first day together with the rest of the students. The reason for this is the materials are in the post already as PFS will have sent all materials 7 days before the stat of the course. PFS will arrange that materials are sent for "late sign-ups" either to the student's address provided at registration or on one of the following days of the course.

13.5 Post and packaging for course materials sent outside of the Republic of Ireland will be charged to the student.

14. Examination and Exam Re-sit

14.1 The "PFS" exams are included in our Course Fees.

14.2 “PFS” do not guarantee that a student will pass exams or that successfully completing a course will provide a student with anything other than the qualification granted under that course, as this is up to the individual.

14.3 Participants who fail a Course must re-sit all failed parts of their examination.

14.4 Registration for re-sit examinations should be completed on www.profi-fitness.ie All repeat exam fees must be paid in full with no less than 5 calendar days before the exam date.

14.5 Examination Re-sit Fees are found in the Additional Costs List and are charged per exam. A student can only be examined 3 times before the whole course needs to be repeated and paid as a new course. The 3 times take into account the examination that’s included in the course plus 2 Exam Re-sits.

14.6 A maximum period of 6 months is allowed between exams. After this period has elapsed, the entire course or module has to be repeated and paid in full.

14.7 Once booked, the Online Exam Re-sit date can’t be changed.

14.8 If the student does not attend exam day and does not notify PFS 14 days before the start of the exam that they will not be present, the next exam will be treated as a repeat exam and hence subject to repeat exam fee.

15. Results Process

15.1 "PFS" is responsible for the decision of issuing certificates.

15.2 Examination results will be sent to participants by e-mail within 10 working days of the exam's completion date. Participants who pass their exam will receive details of the percentage they achieved. Participants who fail will receive percentage information as well as feedback suggesting what areas they should focus on to improve their grade.

15.3 Exact questions and answers on exam papers will not be copied, scanned or sent to participants via email or post. Individuals' exam papers can be viewed at the "PFS" Head Office by appointment only. A fee of applies as per the Additional Costs List.

15.4 Diplomas will be issued and posted to participants, or can be collected from the "PFS" Head Office by appointment only. Certificates for Certificate Courses will be sent in an electronic version, via email.

15.5 If a student fails an examination, a Certificate of Attendance will be issued and the appropriate CPD points. The examination will need to be passed in order for the student to receive the Certification that enables the student get insured and teach.

15.6 The pass rate is 75% or above for all courses that have an exam. If the student achieves 74%, the exam is deemed as failed and no oral questions will be given. The exam has to be re-sited after the appropriate fee has been paid.

15.7 Participants will receive their Diplomas/Certificates within 4 weeks of receiving their exam result.

15.8 Replacement Diplomas can be requested by e-mail at office@profi-fitness.ie A fee applies as per the Additional Costs List. The fee includes postage & packaging.

16. Communication and Contacting “PFS”

16.1 Students are encouraged to swap contact details and network amongst themselves. In the unlikely situation that course materials or course related information doesn’t reach everyone, this will be a good backup plan to ensure nothing is missed.

16.2 The “PFS” team has made extensive efforts to ensure that the published data on the “PFS” website is comprehensive and gives clear details about Qualifications, Accreditation, Exams, etc.

16.3 Having read all available information made available in written form including the Frequently Asked Questions section and you need clarification or additional information please send an email to office@profi-fitness.ie Telephone contact can also be made within normal working hours excepting weekends and bank holidays.

16.4 Email is the preferred contact method due to the fact that most of our staff are actively teaching.

17. Complaints

17.1 All complaints must be submitted by e-mail to manager@profi-fitness.ie in which a participant states dissatisfaction regarding any area or service. Verbal complaints won't be accepted.

17.2 Complaints will be handled in a fair and timely manner. The Manager will respond to the complaint within 10 working days of receiving the e-mail.

Health & Safety Statement

 

The safety & wellbeing of all ProFi Fitness School staff and tutors is of upmost importance to us. Please read our Safety Statement below to ensure your safety and the safety of others while participating in our courses.

  1. ProFi Fitness fully recommend that the each student undertakes a full medical with their GP prior to enrolment. It is the Students responsibility to ensure that they are not suffering from any illness, injury or other medical condition which may hamper complete participation on the course and to inform ProFi Fitness School of any illness, injury or other medical condition that they may have to enable ProFi Fitness School to determine whether any reasonable adjustments can be made.
  2. In the interests of health and safety. ProFi Fitness School requests that Students who are experiencing any cold, flu or similar symptoms which may indicate a contagious infection to refrain from attending classes until their symptoms have passed.
  3. All ProFi Fitness School students must adhere to all health & safety guidelines as outlined at the venue of the course being provided. If you are unsure on the safety guidelines please ask the Manager on Duty at your course venue.

TERMS AND CONDITIONS: “Your Mobility & Flexibility Day”

 

Introductory Provisions

 

  1. The following terms and conditions, along with any relevant legal provisions apply to all persons participating in the “Your Mobility & Flexibility Day” event on the 25th of April 2020. The provisions also apply to the shared facility used in connection with the ongoing event, available upon presentation of an admission ticket or other admission document established by the organizer.

 

General Provisions

 

  1. Admission to the event venue is only possible upon presentation of a valid ticket or email confirmation or any other admission document established by the organizer. Please bring your payment confirmation and ID card with you to the event.
  2. Each person (regardless of age) is required to present, upon request, a valid identity document (such as ID card / passport / driving license / student ID / school ID), whereby an underage person may participate in the event only under parent / guardian supervision. The presentation of both the ticket and the document confirming identity will take place at the entrance to the facility and on the premises of the facility at the request of an authorized person appointed by the organizer or facility manager. Refusal to cooperate in this regard will result in refusal of entry or removal from the event facility / area.
  3. Any person under the influence of alcohol or any other intoxicants may not be admitted and will be removed from the event venue if they pose a threat to the security of the event. The existence of a security risk is determined by persons authorized by the oganizer or facility manager.
  4. The following items may not be brought into the facility:
    1. All types of weapons or explosives, including any object that could be used as a weapon. This includes fireworks, flares, smoke mixtures, smoke candles or other pyrotechnic materials;
    2. All of alcoholic beverages, drugs, stimulants or psychotropic substances;
    3. Racist, xenophobic, vulgar, provocative, religious or political propaganda items and materials;
    4. Aerosol gas, corrosive, flammable substances, dyes or containers containing substances harmful to health or highly flammable;
    5. The above list is not exhaustive. In case of doubt as to the subject brought to the event facility, an authorized person appointed by the organizer is responsible for determining the prohibited and permitted items.
  5. The organizer reserves the right to change the date and time of the event in the event of the so-called force majeure or other events beyond the control of the organizer. The organizer also reserves the right to change the plan of the event.
  6. Everyone present at the event must be aware that they are staying there at their own risk and that they may be liable for damage or loss arising from their activities.

 

Access Rules for Participation in the Event

 

  1. Purchasing a ticket for a given day entitles you to participate in all trainings and lectures that are included in the event plan provided on that day. There are no enrollments for any classes or lectures.
  2. Everyone can take part in the "Your Mobility & Flexibility Day" event. Confirmation from any instructor / trainer or sport qualifications are not required.
  3. On-line registration is open until April 15th until 11:59pm. After this date, the purchase of tickets is possible only on the day of the event at the price set by the organizer.
  4. During registration, each person must provide their individual email address to which a confirmation link will be sent.
  5. The cost of the ticket allows for participation in the entire event (classes and lectures included). The price of the event ticket depends on the date of purchase (monthly price thresholds apply).
  6. Sales invoices for participation in the convention will be issued upon request only based on the information sent by e-mail to myover40@gmail.com.
  7. After registration, the fee must be paid immediately, using the chosen form of online payment.
  8. Tickets are non-returnable and non-refundable.

 

  1. Further resale of tickets at a profit, or their purchase with the intention of resale at a profit, is an offense under 133 § 1 of the Code of Offenses.
  2. The event "Your Mobility & Flexibility Day" can be filmed, but each presenter has the right to refuse filming of his/her lesson.

Consent to Use Images

  1. The organizer may document the course of the event by taking pictures and filming, and then use such fixed materials for the purpose of mass media broadcasting (television, radio, Internet, press) or for the promotion / advertising of the organizer and other persons indicated by the organizer. Participation in the event is equivalent to the participant's consent to the recording, use and / or sharing of content by the organizer, related entities of the image / voice / speech of each participant in all promotional and marketing materials without time and territorial restrictions.
  2. Consent is equivalent to the fact that photographs, films or recordings taken during the event can be posted on the event's website (including all social media: Facebook, Instagram) or other managed by the organizer and used in promotional materials, also shared by means of visuals or sound. The participant hereby waives all claims (existing and future), including remuneration against the organizer for using his image / voice / speech for the purposes specified in these Regulations.
  3. Statements contained in point 18 and 19 are treated as an authorization within the meaning of the Act on Copyright and Related Rights (Journal of Laws of 1994, No. 24, item 83).

Final Provisions

  1. Event participants are required to comply with these regulations and to comply with any regulations of the venue where the event is organized.
  2. Duplicate accounts will be removed.
